This copyright agreement prevails and is binding to the contributing Author(s) and Geospatial Media and Communications Pvt. Ltd.

Ltd, usted confirma, reconoce y acepta de manera expresa los términos y condiciones de este acuerdo de derechos de autor. Este acuerdo de derechos de autor es vinculante entre los Autor(es) contribuyentes y Geospatial Media and Communications Pvt. Ltd.

AUTHOR(s) COPYRIGHT AGREEMENT with Geospatial Media and Communications Pvt. Ltd  / ACUERDO DE DERECHOS DE AUTOR CON Geospatial Media and Communications Pvt. Ltd.

AGREEMENT/ACUERDO:

The Primary Author (henceforth referred as AUTHOR) having submitted the article/ paper (henceforth referred as ARTICLE) and Geospatial Media and Communications Pvt. Ltd (henceforth referred as PUBLISHER), for publishing the ARTICLE on any and all of its platforms, namely - Website(s), Portals, Print magazines, Conference Proceedings of all conferences organized by the publisher (henceforth referred as PUBLICATION PLATFORMS), hereby agree that:

1. The AUTHOR hereby warrants that; s/he is the author of the submitted ARTICLE and all parts thereof; the ARTICLE and associated materials are original; the AUTHOR has consulted all the Co-Authors of the submitted ARTICLE and the submission is with full consensus of all the authors; the ARTICLE does not infringe any copyright, proprietary right or any other right of any third party; and the AUTHOR is the sole owner of the ARTICLE.
    
                                                        
2. The AUTHOR warrants that they/he/she has/have not transferred any rights of the ARTICLE to third parties, which would be in conflict with this agreement; the ARTICLE has not been previously published anywhere including any publication or conference proceedings or material, and the ARTICLE is not under consideration with any other party for publication, except as follows:

3. The AUTHOR grants the PUBLISHER complete rights to publish, copy, distribute, display, store and sell the ARTICLE on any of its PUBLICATION PLATFORMS for fulfilling the organizations goals. These rights to publish, copy, distribute, store and sell are perpetual, worldwide, irrevocable and free of royalty.

4. On publication of the ARTICLE on any of the PUBLICATION PLATFORMS of the PUBLISHER; the AUTHOR needs to seek prior written permission from the PUBLISHER for usage, reproduction or reprint of the ARTICLE for publication with any other third party. The publisher may grant permission to the author for such publication subject to reference to Geospatial Media and Communications Pvt. Ltd in such publication.

5. The ownership of the ARTICLE shall remain with the AUTHOR and this will be acknowledged by the PUBLISHER in the ' by-line' at every reference to the ARTICLE.

6. This agreement sets forth the entire understanding of the AUTHOR and PUBLISHER with respect to the ARTICLE and supersedes any prior understandings

7. Any claims and disputes including the originality of the content of the ARTICLE from any third party shall be a responsibility of the AUTHORS to resolve at his cost and risk. The author shall keep the publisher indemnified against all such claim or disputes.

This agreement shall be governed by the laws of Government of India, which shall be referred to in the event of any issues arising as a result of the publication of the ARTICLE or arising out of this agreement. All disputes arising from or incidental to the present agreement shall be subject to the jurisdiction of courts of Delhi (India).

ACUERDO DE DERECHOS DE AUTOR CON Geospatial Media and Communications Pvt. Ltd.

ACUERDO:

El Autor Primario (de aquí en adelante, EL AUTOR), al haber enviado su artículo/ensayo/ponencia (de aquí en adelante, EL ARTÍCULO) y  Geospatial Media and Communications Pvt. Ltd (de aquí en adelante, EL EDITOR), al publicar EL ARTÍCULO en cualquiera de sus plataformas, en contreto, sitios y portales web, revistas impresas, actas de conferencias (de aquí en adelante PLATAFORMAS DE PUBLICACIÓN), acuerdan por medio del presente que:

1. EL AUTOR manifiesta que EL ARTÍCULO y todas sus partes son de su autoría; que EL ARTÍCULO y todos los materiales relacionados son originales; que EL AUTOR ha consultado a todos los coautores de EL ARTÍCULO enviado y que el envío tiene el completo consentimiento de todos los autores; que EL ARTÍCULO no viola ninguna ley de derechos de autor, de propiedad ni de ningún otro derecho de un tercero; y que EL AUTOR es el único propietario de EL ARTÍCULO.
                                    
2. EL AUTOR garantiza que el/ella/ellos/ellas no ha/han transferido los derechos de EL ARTÍCULO a un tercero, lo cual entraría en conflicto con este acuerdo; que EL ARTÍCULO no ha sido publicado previamente en ningún lugar, incluyendo publicaciones, actas o materiales de conferencias y que EL ARTÍCULO  no está siendo considerado por ninguna otra parte para su publicación, excepto en los siguientes casos:

EL AUTOR otorga a ELEDITOR los derechos completos para publicar, copiar, distribuir, mostrar, almacenar o vender EL ARTÍCULO en cualquiera de sus PLATAFORMAS DE PUBLICACIÓN para cumplir con los objetivos de la organización. Estos derechos para publicar, copiar, distribuir, almacenar y vender son perpetuos, en todo el mundo, irrevocables y libres de regalías.

4. En la publicación de EL ARTÍCULO en cualquiera de las PLATAFORMAS DE PUBLICACIÓN; EL AUTOR debe buscar previamente el permiso por escrito por parte de EL EDITOR  para usar, reproducir o reimprimir EL ARTÍCULO para su publicación con cualquier tercero. EL EDITOR puede otorgar permiso a EL AUTOR para dicha publicación sujeto a la referencia a Geospatial Media and Communications Pvt. Ltd en dicha publicación.

5. La propiedad de EL ARTÍCULO seguirá siendo de EL AUTOR y esto será reconocido por EL EDITOR en cada referencia a EL ARTÍCULO.

6. Este acuerdo enuncia el completo entendimiento de EL AUTOR y de EL EDITOR con respecto a EL ARTÍCULO y prevalece por encima de cualquier acuerdo previo.

7. Cualquier reclamo o disputa incluyendo la originalidad del contenido de EL ARTÍCULO de cualquier tercero será responsabilidad de EL AUTOR bajo su propio costo y riesgo. EL AUTOR mantendrá a EL EDITOR fuera de cualquiera de estos reclamos o disputas.

Este acuerdo se regirá bajo las leyes del Gobierno de la India, al cual se apelará en caso de cualquiera de los asuntos que surjan como resultado de la publicación de EL ARTÍCULO o como resultado de este acuerdo. Todas las disputas que surjan de manera directa o incidental del presente acuerdo estarán sujetas a la jurisdicción de las cortes de  Delhi (India).
